Does COPD Count as a Disability Under UK Law?

COPD does not stop you working. For a lot of people, it changes how you work — and that distinction matters.

Under the Equality Act 2010, a disability is a physical or mental impairment that has a substantial and long-term adverse effect on your ability to carry out normal day-to-day activities. Substantial means more than minor. Long-term means lasting, or likely to last, at least 12 months.

COPD is a progressive condition. Depending on severity, it can affect breathing, energy levels, the ability to walk distances, tolerate temperature changes, or sustain physical exertion. For most people with a COPD diagnosis, the condition meets the legal threshold — though this depends on individual circumstances and severity.

This matters because the Equality Act gives you specific protections. Employers cannot discriminate against you because of your COPD. They have a legal duty to make reasonable adjustments. And they cannot withdraw a job offer simply because of your condition. For a full overview of your rights at work, the free Disability at Work guide covers the legal framework in plain English.

Job Searching With COPD: What to Think About

Before you start applying, it is worth being honest with yourself about which roles are realistic given your current symptoms — and which might put you at unnecessary risk. That is not limiting your ambitions. It is finding roles where reasonable adjustments can bridge the gap between what the job asks for and what your condition makes difficult.

Things worth considering when reviewing job adverts: whether there are significant physical requirements (construction, outdoor fieldwork, standing for long periods); whether hybrid or home working is offered or requestable — remote working reduces commuting, which for many people with COPD is one of the most physically demanding parts of the day; whether the workplace is accessible; and whether flexible hours are possible. Fatigue is a real feature of COPD for many people. A flexible start time or compressed hours may be a straightforward reasonable adjustment worth requesting.

The Disability Confident scheme identifies employers who have committed to inclusive recruitment. A Disability Confident employer is required to interview all disabled applicants who meet the minimum criteria for a role. It is worth checking whether an employer carries the badge before applying. For a full overview of disability in job applications including the Disability Confident scheme, see the Disability and Job Applications UK guide.

Your CV and Application

You are under no obligation to mention COPD on a CV or in a cover letter. There is no box you have to tick before an offer is made. What your CV needs to do is demonstrate that you can do the job. Focus on your skills, your experience, and the specific outcomes you have delivered.

If you have had a health-related career gap, address it simply and briefly — “following a period of ill health, I am now fully focused on returning to [role type]” — without over-explaining. For detailed guidance on handling career gaps, including a ready-to-use CV statement generator, see our guide on employment gaps on your CV.

One place where early disclosure can work in your favour: the Disability Confident tick box on application forms. If an employer is a genuine participant, ticking the box means they commit to interviewing you if you meet the minimum criteria. This is a practical decision to weigh against how comfortable you feel disclosing at that stage.

The UK Jobseeker’s Playbook 2026 covers CVs, LinkedIn, interviews, and salary negotiation in one place and is a practical reference throughout your job search. If you are changing career as well as managing COPD, the Career Change UK 2026 guide takes you through the eight-step process in full.

The Interview: What to Prepare, When to Disclose

Employers cannot legally ask you about your health or disability before making a job offer, with very limited exceptions. They can ask whether you need adjustments to access the interview itself.

If your COPD means you need adjustments to participate in the interview on equal terms, request them in writing when you receive your invitation. Common adjustments that may be relevant: a ground-floor or lift-accessible venue, a room with good ventilation and no strong scents or irritants, adequate rest breaks if the process is long, additional time for any written or physical assessment component, and a telephone or video interview instead of in-person if travel is difficult.

For the interview itself, prepare as thoroughly as any other candidate. Know the organisation. Map your experience to the job description. Prepare specific examples of your work. If the interviewer asks about your condition directly, keep the focus on your capability:

“I manage my condition well in a work context — it has not affected my ability to [key relevant skill]. I may need [specific adjustment] in the role, which I am happy to discuss once an offer is made.”

That is enough. You are not obliged to go further. Our full guide on interviewing with a disability covers the disclosure decision and how to handle difficult questions in detail. The Interview Question Bank lets you practise real interview questions with AI feedback before your interview.

Your First Day and First Weeks

Once an offer has been made, the employer has a legal duty to explore reasonable adjustments with you. This is the right time to be specific about what you need.

Common adjustments for people managing COPD in the workplace include: working from home fully or partially to reduce commuting; a desk away from windows that open onto high-pollution areas or strong cleaning product use; flexible start and finish times to avoid peak commute or temperature extremes; additional short breaks, particularly on days when symptoms are worse; avoiding tasks that require sustained physical exertion; a parking space close to the building entrance; and access to a quiet area for rest if needed.

You do not need to provide a detailed medical history to request any of these. A general description of how your condition affects you in a work context is sufficient. For a step-by-step guide to making the request, including a ready-to-use email template, see our guide on how to request reasonable adjustments at work.

It is also worth registering with Access to Work — a government-funded scheme through the DWP that can provide financial support for specialist equipment, transport to work, or communication support at interviews. It is separate from your employer’s obligations and can supplement adjustments considerably.

If Your Condition Changes

COPD is progressive. Your adjustments may need to change over time as your condition does. You are entitled to review your adjustments at any point — it does not require starting the process from scratch.

Keep a written record of any adjustments agreed. If your employer later removes or fails to maintain adjustments without discussion, that may constitute discrimination arising from a disability under the Equality Act. ACAS provides a free early conciliation service that can help resolve disputes without going to tribunal.
